A Gold Coast man has lost his job after his employer confronted him about derogatory comments he published on Facebook.

Jason Dowling, who worked on the Hinze Dam Project managed by Thiess Pty Ltd, has been stood down after admitting to posting offensive remarks following a tip-off by a member of the public.

A 25-year-old law student from Lismore who only wanted to be identified as Caroline told ninemsn she emailed Thiess on January 30 with a link to Mr Dowling’s Facebook page.

Four days later she received a response from Thiess group HR manager Mark Vining saying Mr Dowling’s employment at the company had been terminated following an investigation.

In addition, a second unidentified employee was also fired and a third tendered his resignation.

“Those comments are in no way supported by our business practices, are in breach of various Company and Project policies, and certainly not encouraged or endorsed by the management of Thiess,” Mr Vining wrote in that letter.

“Thiess has a long and proud history of promoting diversity and equality in our workforce, and have many programmes in place to support these objectives.”

Caroline told ninemsn she first saw screen shots of Mr Dowling’s comments posted on the website PWSNT.com and “out of curiosity” looked him up on Facebook…

Jason’s comments were admittedly pretty bad–Muhammad Ali is “just another loud mouth nigger”; an Aborigine with a stutter is a “cocoon”; Dreamworld is sadly “full of gooks n Muslims”; blah blah blah–but not all that unusual. There are mountains of hateful idiocy on Facebook, which The Antibogan blog regularly documents.

Brendon Lee O’Connell found guilty of racial hatred

    Update, January 31, 2011. Brendon O’Connell has been sentenced to three years jail for his crimes. O’Connell has the distinction of being the first person to be successfully prosecuted under WA’s laws against racial and religious vilification, legislation introduced following the racist violence of the neo-Nazi ‘Australian Nationalists Movement’ under Jack Van Tongeren. Van Tongeren’s former arch-nemesis is Dr James Saleam, leader of the Australia First Party. AF has urged its followers to support O’Connell, whom the party denies is anti-Semitic and argues is instead merely a good Christian.

A PERTH man who posted a video online showing him arguing with a Jewish man and calling him a “racist, homicidal maniac” has been found guilty of racial hatred.

Brendan [sic] Lee O’Connell, 38, represented himself before a jury in the Perth District Court after firing the lawyer who had been defending him against an accusation that he posted an anti-[S]emitic video online.

O’Connell faced seven charges related to the posting of a verbal altercation he had with Stanley Keyser and Timothy Peach, who are Jewish, and was found guilty on six.

An argument broke out between the three men at an IGA supermarket in South Perth on May 2, 2009, where a Friends of Palestine group was holding a protest against Israeli oranges.

Mr Peach, 19, told the court during the trial that he was a member of the Australasian Union of Jewish Students at the time and had attended the rally to “observe” and hand out flyers to educate the protesters about Israel.

He said he was “angry”, “confused” and “offended” by O’Connell when he started to film the two Jewish men and argue with them about their religion.

During the trial, O’Connell refused to acknowledge Judge Henry Wisbey when he entered the court and, instead, rose to bow to the jury.

About a dozen supporters in the court cheered when O’Connell labelled the proceedings “a kangaroo court” and gave a long, repetitive rant about the King James Bible and the Constitution.

The video that O’Connell posted online was shown on the first day of the trial.

“You have a religion of racism, hate, homicide and ethnic cleansing,” O’Connell says to the men on the video.

“You are a racist, homicidal maniac.”

When the jury found O’Connell guilty on Friday, he shouted: “Free Palestine! Free Iraq!” before being taken away.

Outside court, Mr Keyser’s mother Shelley said it was “a big relief” for the “terrible” ordeal to be over.

O’Connell was remanded in custody and is due to reappear in court on Monday.

Walk like an Egyptian

A rally in solidarity with revolting Egyptians has been called for this Sunday from 3pm @ the Consulate General of the Arab Republic of Egypt, (Level 6) 50 Market Street, Melbourne. The official tag is ‘Come and support the right of the Egyptian People to choose their government and parliament’. Being Sunday, the Consulate will be closed. Also, seeing as it’s gonna be like 40°C or something, it’s probably a good idea to take supplies if you’re going. Otherwise… President Muhammad Hosni Mubarak’s regime is in some slight trouble ’cause of public protest, but moreover ’cause of who’s gonna take over after he goes he goes he just goes. ‘Mubarak’s Last Breath’ by Adam Shatz (May 2010) provides a neat overview of the historical background, while Robert Fisk (January 28, 2011) reckons ‘Egypt’s day of reckoning’ has arrived.

People talk of revolution but there is no one to replace Mubarak’s men – he never appointed a vice-president – and one Egyptian journalist yesterday told me he had even found some friends who feel sorry for the isolated, lonely President. Mubarak is 82 and even hinted he would stand for president again – to the outrage of millions of Egyptians.

The barren, horrible truth, however, is that save for its brutal police force and its ominously docile army – which, by the way, does not look favourably upon Mubarak’s son Gamal – the government is powerless. This is revolution by Twitter and revolution by Facebook, and technology long ago took away the dismal rules of censorship.

A real crisis of leadership among the ruling elites in Egypt, in other words, and also a revolution facilitated by Facebook, Inc. and Twitter Inc.. Jadaliyya is an interesting sauce of infos too, and one writer sounds a horribly optimistic note:

We were told, time and again, that “revolution” and “the people” were obsolete terms, irrelevant in a post-revolutionary world, especially in the Arab world. This, after all, was a place where the burden of the past weighed so heavily and the cultural DNA somehow preconditioned those who carried it to feel more at home with tyrants and terror. Too many trees were killed theorizing about the region’s inhospitability to democracy. “Reform” was the most one could hope for. Revolution? No way! That was the stuff of outmoded leftists and dreamers left behind as history marched forward. The referent for “revolution” resided in the past (or in the west), but never in the present, or near future. The latter, was eternally deferred. Revolutions were dormant in archives, dictionaries and documentary footage. Revolutions were celebrated and imagined in songs and poems fading from collective memory and oral history.

Even those of us who didn’t buy into this narrative for obvious reasons fell prey to despair and pessimism. It wasn’t just hereditary dictatorships mushrooming left and right, but neocolonialism, military occupations, sectarianism and civil wars. It was even difficult, at times, to be a pessoptimist à la Habibi.

Then there was Tunisia…

January 26, 1788. Eleven under-supplied and massively overcrowded ships arrive in ‘Botany Bay’ as part of a commercial, for-profit operation, financed by the British Government. The voyagers are roughly divided into two: of the 1,500 or so on board, half are convicts. All are from England, most from London. Those subject to transportation are poor, mostly illiterate, ill-fed and ill-treated, kept in chains, almost always in darkness, and have very little idea of the nature of their voyage or the troubles that will greet them on their arrival. It is a 15,000-mile journey which takes 252 days: 48 die during the passage. The oldest female convict is 82-year-old Dorothy Handland. Convicted of perjury, she hangs herself from a tree in 1789: Australia’s first recorded suicide.

January 26, 2011. One un-recognised and massively bored blogger regains consciousness in the midst of a commercial, for-profit society, secretly controlled by shape-shifting lizards. In dreams, the members of this society are roughly divided into two great hostile camps, into two great classes directly facing each other — Bourgeoisie and Proletariat. In reality, of the 15,000 or so who have an annual individual income over $700,000 a year, none are convicted.

The proposal to colonize Botany Bay with convicts was formally drawn up in an unsigned document titled “Heads of a Plan for effectually disposing of convicts” and was presented to the British cabinet in August 1786. Its emphasis was clear: The proposed colony would serve as “a remedy for the evils likely to result from the late alarming and numerous increase of felons in this country, and more particularly in the metropolis.” The secondary benefit of the region’s raw materials was presented at the end of the document: “It may also be proper to attend to the possibility of procuring masts and ships’ timber for the use of our fleets in India, as the distance between the two countries is not greater than between Great Britain and America…”

In their most sanguine moments, the authorities hoped that Australia would eventually swallow a whole class — the “criminal class,” whose existence was one of the prime sociological beliefs of late Georgian and early Victorian England. Australia was settled to defend English property not from the frog-eating invader across the Channel but from the marauder within. English lawmakers wished not only to get rid of the “criminal class” but if possible to forget about it. Australia was a cloaca, invisible, its contents filthy and unnameable. Jeremy Bentham, inveighing against the “thief-colony” in 1812, argued that transportation: “…was indeed a measure of experiment… but the subject-matter of experiment was, in this case, a peculiarly commodious one; a set of animae viles, a sort of excrementitious mass, that could be projected, and accordingly was projected — projected, and as it should seem purposely — as far out of sight as possible.”

Change the Australian flag to a giant dick campaign endorsed by glittering array of celebrities

MORE than a dozen non-former Australians of the Year have sparked a fresh debate on the national flag, saying the time for change is long overdue.

In an unprecedented show of strength and purpose, the award non-recipients signed a statement saying the present flag is a transitional symbol that “highlights and promotes the flag of another nation”, the British Union Jack.

“Let’s face it”, Patricia McSorry, the gregarious 2010 award non-winner, said yesterday, “The current Australian flag is boring and unoriginal”.

“It’s time Australia loosened up. The design of the flag should be entrusted to a slowly maturing Generation Y adolescent, a 27-year-old who just won’t leave home,” she said, calling on the nation to embrace its status as “super laid back”.

Professor McSorry, a mental health expert who believes a new flag is now an “achievable goal” on the way to the greater prize of a new car, is one of 15 former winners to have signed a statement calling for change…

Richard Wolstencroft ~versus~ Richard Wolstencroft

In brief: several weeks ago, self-described “transcendental fascist” and filmmaker Richard Wolstencroft commenced legal action against a blogger named Shane Lyons. Richard has accused Shane of stalking and defaming him. On January 11, Richard applied for an intervention order against Shane preventing him from publishing online any material critical of Richard. The (interim) order was not granted, and further hearings are scheduled to take place later in the year.

For the benefit of those of you arriving late, Shane has a blog titled ‘Richard Wolstencroft’s Freedom Ride’ which has republished various comments, mostly regarding politics, Richard has made on his Facebook account. Here Richard, inter alia, has expressed the view that apart from engaging in a few excesses–which may now, in hindsight, be forgiven–the Nazi regime was a basically benign force, committed to establishing order in Europe. Further, that WWII was the result of British arrogance and that Hitler, if he had been allowed to rule Europe, would have protected the British Empire from its enemies.

Hitler’s failure to enact his vision has now resulted, sadly, in parts of London resembling Afghanistan.

Apart from expressing distaste for demographic change in Londinium, in his other commentary Richard expresses the fears and anxieties common to thousands of other Australians regarding refugees, immigration, deracination, cultural and political decadence: the kinds of views which Theantibogan (or perhaps pwsnt) and a handful of other blogs spend some time examining (albeit, in Richard’s case, with better spelling and grammar than is typical).

Unlike most of the so-called ‘bogans’ who express admiration for Hitler or hatred and contempt for refugees, however, Richard has a public profile, derived in large part from his role as Director of the Melbourne Underground Film Festival (MUFF). The Festival, which Richard inaugurated in 2000 after one of his films was rejected by the Melbourne International Film Festival (MIFF), will this year be celebrating its 11th birthday.

Over time, MUFF has managed to attract some small following (the exact size of which varies considerably according to the source) and a degree of support from the business and corporate sector. In 2010, the major sponsor was Canon. To the extent that Richard’s apparent embrace of fascism and xenophobia reflects badly on MUFF, it mitigates against the possibility of the Festival attracting wider support, especially from businesses wary of associating themselves with the propagation of racism and fascism. The Facebook comments Shane has republished on his blog, then, would appear to have embarrassed Richard, and as noted he is now using legal means to have them removed, and to apply for a gag to to be placed on Shane to prevent him from further criticising Richard’s politics. Note also that prior to this latest court action, Richard successfully lobbied WordPress.com to have ‘Richard Wolstencroft’s Unconcealedness’, Shane’s previous blog, closed down. This was agreed to on the grounds that Shane’s blog was engaged in copyright violation (viz, Richard had copyright over his Facebook commentary, and in republishing this commentary without Richard’s permission, Shane was violating Richard’s intellectual property rights).

Or something like that. Crikey‘s Luke Buckmaster reviewed some of the issues raised in a post on his blog in September last year (*UPDATED** – Ferocious film politics: ex-MUFF volunteer launches smear campaign against festival director, September 7, 2010); Richard has a few choice words for “[t]hat ratbag stalker and total tool Shane Lyons” here.

The issues raised by Richard’s legal action are interesting ones, especially those which relate to copyright but also, moreover, in light of Richard’s public reputation as an advocate of ‘freedom of speech’. After all, it was partly on this basis that Richard was invited to launch the Australian Sex Party’s state election campaign in Melbourne last year. According to Richard, however, ‘freedom of speech’ is one thing, defamation another, and in re-publishing Richard’s Facebook commentary without his permission Shane is guilty of both stalking and defamation. In either case, on January 22 Shane published the following announcement on his blog. I republish it here because I think it deserves a wider audience.

You might have heard by now that Richard Wolstencroft, director of the Melbourne Underground Film Festival, has finally been charged over the illegal screening of LA Zombie back in August. He’s been offered a slap on the wrist – a diversion notice, which would require him to pay a “donation” to a charity. His mates at Beat magazine were the first with the news [here].

Australia’s classification/censorship laws are ridiculous, with tighter – and more inconsistent – restrictions on what adults are allowed to watch than most Western countries, completely banning films like LA Zombie and Ken Park; video games that would get an “R” rating if one existed; and videos about graffiti “vandals”, giving them the same legal status as bomb-making instructions. For these reasons I support MUFF’s protest screening of LA Zombie.*

But Richard Wolstencroft is currently embroiled in another court case – concerning someone else’s freedom to expose and criticise Richard’s racist and neo-fascist political views, and instigated by the man himself.

Two days before the new year I was served with a Summons and Application for an Intervention Order, in relation to this website [link].

At the initial hearing on January 11 I declined to make formal undertakings to stop monitoring Richard’s Facebook page and publicly criticising him. I said I would defend the case, and the full hearing is likely to be in May or June.

The magistrate refused to grant Richard an interim order against me, on the grounds that there was no indication of danger to person or property. This was even before I pointed out that he felt so threatened he waited four months before applying for the order, and sent his girlfriend around to knock on my door and talk to me, pretending she was looking for someone else.**

There’s not much more I want to say about this publicly just yet, but because Wolstencroft has continued to spray his “stalking” accusations around I have to make a couple of basic points, which will also be part of my defence in the court case.

• Richard treats his Facebook page as primarily a blog for speaking to an audience, accepting “friend” requests no questions asked, including from my pseudonymous account. He has over 1300 Facebook “friends”, including Travis Bickle and Blackbeard the Pirate.
• My focus has always been on his politics, his use of MUFF as a platform for promoting his politics, and his use of this supposedly non-profit film festival for his personal gain. I have never taken any interest in his personal life.
• His far-right politics are extreme, appalling and a poisonous presence in the Australian film community, and they need to be criticised in the strongest possible terms. Should someone who writes things like this have the right to stifle criticism?

“…the Nazis only wanted a united Europe like the EU, anyway, in essence. They were a little excesses [sic]. But that can be forgiven now given some historical distance. WW2 was a pointless civil war brought on by British arrogance. Hitler would have protected the British Empire and it would exist in a greater glory to this day if he had been allowed to. In the end England has lost everything and parts of London now resemble Afghanistan. Some Victory!”

* Mind you, Richard said at the time that he would screen something else if the police showed up. Margaret Pomeranz, when she tried to screen Ken Park in 2003, at least had the guts to still hit the play button with the police already there and waiting to pounce [link].
** This was apparently to verify my address. It was another 17 days before he applied for the order.
