January 26, 1788. Eleven under-supplied and massively overcrowded ships arrive in ‘Botany Bay’ as part of a commercial, for-profit operation, financed by the British Government. It is a 15,000-mile journey which takes 252 days: 48 die during the passage. The oldest female convict is 82-year-old Dorothy Handland. Convicted of perjury, she hangs herself from a tree in 1789: Australia’s first recorded suicide.

The proposal to colonize Botany Bay with convicts was formally drawn up in an unsigned document titled “Heads of a Plan for effectually disposing of convicts” and was presented to the British cabinet in August 1786. MORE than a dozen non-former Australians of the Year have sparked a fresh debate on the national flag, saying the time for change is long overdue.
In an unprecedented show of strength and purpose, the award non-recipients signed a statement saying the present flag is a transitional symbol that “highlights and promotes the flag of another nation”, the British Union Jack.
“Let’s face it”, Patricia McSorry, the gregarious 2010 award non-winner, said yesterday, “The current Australian flag is boring and unoriginal”.
“It’s time Australia loosened up. The design of the flag should be entrusted to a slowly maturing Generation Y adolescent, a 27-year-old who just won’t leave home,” she said, calling on the nation to embrace its status as “super laid back”.
Professor McSorry, a mental health expert who believes a new flag is now an “achievable goal” on the way to the greater prize of a new car, is one of 15 former winners to have signed a statement calling for change…
In brief: several weeks ago, self-described “transcendental fascist” and filmmaker Richard Wolstencroft commenced legal action against a blogger named Shane Lyons. Richard has accused Shane of stalking and defaming him. On January 11, Richard applied for an intervention order against Shane preventing him from publishing online any material critical of Richard. The (interim) order was not granted, and further hearings are scheduled to take place later in the year.
For the benefit of those of you arriving late, Shane has a blog titled ‘Richard Wolstencroft’s Freedom Ride’ which has republished various comments, mostly regarding politics, Richard has made on his Facebook account. Here Richard, inter alia, has expressed the view that apart from engaging in a few excesses–which may now, in hindsight, be forgiven–the Nazi regime was a basically benign force, committed to establishing order in Europe. Further, that WWII was the result of British arrogance and that Hitler, if he had been allowed to rule Europe, would have protected the British Empire from its enemies.
Hitler’s failure to enact his vision has now resulted, sadly, in parts of London resembling Afghanistan.
Apart from expressing distaste for demographic change in Londinium, in his other commentary Richard expresses the fears and anxieties common to thousands of other Australians regarding refugees, immigration, deracination, cultural and political decadence: the kinds of views which Theantibogan (or perhaps pwsnt) and a handful of other blogs spend some time examining (albeit, in Richard’s case, with better spelling and grammar than is typical).
Unlike most of the so-called ‘bogans’ who express admiration for Hitler or hatred and contempt for refugees, however, Richard has a public profile, derived in large part from his role as Director of the Melbourne Underground Film Festival (MUFF). The Festival, which Richard inaugurated in 2000 after one of his films was rejected by the Melbourne International Film Festival (MIFF), will this year be celebrating its 11th birthday.
Over time, MUFF has managed to attract some small following (the exact size of which varies considerably according to the source) and a degree of support from the business and corporate sector. In 2010, the major sponsor was Canon. To the extent that Richard’s apparent embrace of fascism and xenophobia reflects badly on MUFF, it mitigates against the possibility of the Festival attracting wider support, especially from businesses wary of associating themselves with the propagation of racism and fascism. The Facebook comments Shane has republished on his blog, then, would appear to have embarrassed Richard, and as noted he is now using legal means to have them removed, and to apply for a gag to to be placed on Shane to prevent him from further criticising Richard’s politics. Note also that prior to this latest court action, Richard successfully lobbied WordPress.com to have ‘Richard Wolstencroft’s Unconcealedness’, Shane’s previous blog, closed down. This was agreed to on the grounds that Shane’s blog was engaged in copyright violation (viz, Richard had copyright over his Facebook commentary, and in republishing this commentary without Richard’s permission, Shane was violating Richard’s intellectual property rights).
The issues raised by Richard’s legal action are interesting ones, especially those which relate to copyright but also, moreover, in light of Richard’s public reputation as an advocate of ‘freedom of speech’. After all, it was partly on this basis that Richard was invited to launch the Australian Sex Party’s state election campaign in Melbourne last year. According to Richard, however, ‘freedom of speech’ is one thing, defamation another, and in re-publishing Richard’s Facebook commentary without his permission Shane is guilty of both stalking and defamation. In either case, on January 22 Shane published the following announcement on his blog. I republish it here because I think it deserves a wider audience.

You might have heard by now that Richard Wolstencroft, director of the Melbourne Underground Film Festival, has finally been charged over the illegal screening of LA Zombie back in August. He’s been offered a slap on the wrist – a diversion notice, which would require him to pay a “donation” to a charity. His mates at Beat magazine were the first with the news [here].
Australia’s classification/censorship laws are ridiculous, with tighter – and more inconsistent – restrictions on what adults are allowed to watch than most Western countries, completely banning films like LA Zombie and Ken Park; video games that would get an “R” rating if one existed; and videos about graffiti “vandals”, giving them the same legal status as bomb-making instructions. For these reasons I support MUFF’s protest screening of LA Zombie.*
But Richard Wolstencroft is currently embroiled in another court case – concerning someone else’s freedom to expose and criticise Richard’s racist and neo-fascist political views, and instigated by the man himself.
Two days before the new year I was served with a Summons and Application for an Intervention Order, in relation to this website [link].
At the initial hearing on January 11 I declined to make formal undertakings to stop monitoring Richard’s Facebook page and publicly criticising him. I said I would defend the case, and the full hearing is likely to be in May or June.
The magistrate refused to grant Richard an interim order against me, on the grounds that there was no indication of danger to person or property. This was even before I pointed out that he felt so threatened he waited four months before applying for the order, and sent his girlfriend around to knock on my door and talk to me, pretending she was looking for someone else.**
There’s not much more I want to say about this publicly just yet, but because Wolstencroft has continued to spray his “stalking” accusations around I have to make a couple of basic points, which will also be part of my defence in the court case.
• Richard treats his Facebook page as primarily a blog for speaking to an audience, accepting “friend” requests no questions asked, including from my pseudonymous account. He has over 1300 Facebook “friends”, including Travis Bickle and Blackbeard the Pirate.
• My focus has always been on his politics, his use of MUFF as a platform for promoting his politics, and his use of this supposedly non-profit film festival for his personal gain. I have never taken any interest in his personal life.
• His far-right politics are extreme, appalling and a poisonous presence in the Australian film community, and they need to be criticised in the strongest possible terms. Should someone who writes things like this have the right to stifle criticism?

* Mind you, Richard said at the time that he would screen something else if the police showed up. Margaret Pomeranz, when she tried to screen Ken Park in 2003, at least had the guts to still hit the play button with the police already there and waiting to pounce [link].
** This was apparently to verify my address. It was another 17 days before he applied for the order.
Whether or not he’ll actually lose his job is an open question at this point.

In Sofia, Bulgaria, Jock Palfreeman‘s appeal hearings have finally, after having begun in October 2010, ended. The court, in its wisdom, has decided to delay its final decision until some point in the next 30 days (see below).
There were many, er, “irregularities” in the original trial which terminated in December 2009 and at which Jock was sentenced to 20 years jail for the crime of murder. The most complete account available to the public of the deficiencies in the prosecution’s case is Dr. Simon Palfreeman’s closing address to the court.
Given that roughly the same conditions obtain then as now, it’s unlikely that the appeal will succeed. Assuming it doesn’t, a further appeal to Bulgaria’s High Court is possible; certainly, it would only be after this further appeal was exhausted that a final appeal might be launched within the EU court system. This is, in my opinion, the most likely scenario, and the EU courts are certainly better placed to address both allegations of corruption within the legal and political systems in Bulgaria, on the one hand, and the many failings of the police investigation and judicial process, on the other hand, which together have arguably exercised undue influence over the outcome.
In addition to a range of other sources, several recent Wikileaks confirm that US and EU officials are well aware of the endemic nature of this corruption. Most recently, the government has become embroiled in a corruption scandal involving the Prime Minister Boiko Borissov: only the support of the ultra-nationalist Ataka party has prevented its downfall. Of course, the allegations of corruption are unproven, appear to be politically-motivated, and the government also has other concerns, including the fate of the Belene Nuclear Power Plant.
(Note that both Bulgarian anarchists belonging to the Federation of Anarchists in Bulgaria (ФАБ / FAB), Australian and Bulgarian neo-Nazis have urged the courts to impose the harshest possible penalty upon Palfreeman.)
Bulgarian prosecutors demand life sentence for Australian convicted of fatal stabbing in Sofia

SOFIA, Bulgaria — Bulgarian prosecutors demanded a life sentence Wednesday for an Australian man who is appealing his conviction for stabbing a student to death.
Paul “Jock” Palfreeman was sentenced to 20 years in jail in December 2009 for fatally stabbing one man and wounding another during a street brawl in the Bulgarian capital, Sofia.
Palfreeman, 24, has appealed the verdict, claiming he acted in self-defence after intervening to prevent an attack on a group of Roma. The court will announce its final verdict within a month.
In his final plea Wednesday, the Australian insisted he stabbed Andrei Monov in self-defence after the Bulgarian student and his friends attacked him.
The defendant said that on the night of the incident he tried to defend two Roma who were attacked by Monov and his group of about 15 friends. He argued he was defending his own life as well, adding that the charges against him were based “on intrigue and hearsay and not on arguments.”
Before the hearing, a human rights activist observing the trial also criticized some court proceedings.
“Our worries are about the unfair trial due to the lack of appropriate evidence uncovered by the investigation, due to inadequate assessment of the court of this evidence, and due to the unjust sentence,” Krasimir Kanev, head of the Bulgarian Helsinki Committee, told APTN.
During final arguments, the prosecution claimed that Palfreeman had killed the victim deliberately and demanded a life sentence.
The court heard also the victim’s father, Hristo Monov, who claimed the judges would become accomplices to a future murder if they reduced the Australian’s sentence when they released their final verdict.
He said that, instead of having his sentence reduced, Palfreeman should have his penalty increased to life without parole for stabbing his son.
Palfreeman has been in custody since the Dec. 2007 attack.
Note that in Moscow, which has a thriving fascist movement and like Bulgaria a strong and influential far right, police have reportedly arrested 21 anti-fascist protesters attending a rally to commemorate the murder on January 19, 2009 of corporate human rights lawyer Stanislav Markelov and trollumnist journalist Anastasiya Baburova. The charges apparently include things like wearing a mask.

In the UK, several police officers belonging to the National Public Order Intelligence Unit have recently been exposed after infiltrating environmental protest movements. In Australia:
A former police officer who worked in the phone intercept unit has been charged after he allegedly attempted to warn a man that he was under surveillance as part of a secret investigation into the Perth branch of international neo-nazi outfit Combat 18.
Robert David Critchley, 42, appeared in Perth Magistrate’s Court yesterday charged with attempting to pervert the course of justice and unlawful use of a police computer.
Police alleged he tied to tell Jacob Marshall Hort that his mobile phone was being monitored.
Hort, of High Wycombe, is reportedly part of the Perth branch of race-hate group Combat 18, which is known for being behind the bombings of Asian communities in London in the 1990s [?].
Hort was convicted in July of criminal damage and discharging a firearm over an incident in which several shots were fired at the Queens Park Suleymaniye Mosque, causing $15,000 damage.
Mr Critchley, of Ocean Reef, was attached to the State intelligence division in January last year when it is alleged he made attempts to tell Hort he was the target of a police investigation into Combat 18’s activities.
It is also alleged that between May 2009 and January 2010 he accessed details of a person through a police computer when he was not permitted to do so.
The two charges are unrelated.
Mr Critchley resigned from the police service in September after Police Minister Rob Johnson approved a recommendation from Police Commissioner Karl O’Callaghan that he be removed.
Mr Critchley previously worked as a police officer in Britain and served as a WA police officer for six years.
He was not required to plead yesterday and has been released on bail to appear in court in April.
Mr Critchley broke into a sprint to avoid waiting media when he left the court.
Combat 18 was formed in Britain in 1991 [?] and has links to the far-right British Nationalist Party [?]. It is not known when the group started in Perth but it is believed police began monitoring members’ activities in late 2009.
Combat 18 in Perf done a website, terrormachine.net, which they took over from the Norwegian franchise in February 2009. (The site was regoed to Hort using a pseudo.) Relations between Combat 18 and fellow nutzis in Blood & Honour (Australia)/(Southern Cross) Hammerskins have been rocky at the best of times, but since the abortive gig, and the developing bond between (the remnants of) Combat 18 and (the Australian franchise of) another (US-based) bonehead gang called Volksfront, things have gotten even more poisonous.
Police in Perf have reason to be especially sensitive to neo-Nazi organising in that part of the world as the last time a groupuscule got going it caused quite a bit of trouble. In the 1980s, the ‘Australian Nationalists Movement’ under ‘Java’ Jack van Tongeren tried to kick-start a race war by blowing shit up and setting buildings on fire. Things didn’t quite go according to The Master Race’s plan however, as an alleged police informant was murdered, and the gang’s leadership was sent to jail.
Upon his release a few years ago, Jack tried, with the help of some rooly patriotik yoof, to embark upon a Senatorial campaign. The yoof in this instance rallied to the cause by re-decorating synagogues and old people’s homes and threatening to kill and otherwise injure their political opponents. Again, the story ended badly. This law is currently being used to prosecute a local anti-Semite named Brendon O’Connell. If successful, it will be the first time a person has been convicted under the relevant Act.

If B&H is correct, then C18 operates in both Perf and Sydney, has been meeting regularly in Chippendale, and attempted to stage a hostile takeover of the Humanist Society of NSW.
