    Admitted neo-Nazi Bill White will stay in jail until he’s returned to face federal criminal charges in Roanoke. A judge denied bond for White Friday morning in Chicago. White has been in federal custody since last year when he was charged in Chicago with using his website [overthrow.com] and other methods to encourage violence. Later, prosecutors in Roanoke added similar charges. Last week, Judge Lynn Adelman threw out the Chicago case citing freedom of speech protections. Adelman wrote “an intimidating context alone does not remove the protection of the first amendment.” White’s Chicago lawyer, Chris Shepherd, argued Friday that White should be released on bond as he awaits trial in Roanoke. “No one’s ever been harmed by Mr. White,” Shepherd told News-7. “He’s spent nine months in jail for a crime he did not commit.” Shepherd said it is uncertain how long it might take federal authorities to bring White back to Roanoke. He said it could take several weeks, if not months.

So. What do imprisoned neo-Nazi Hal Turner, New Yawk fashion model Liskula Cohen, Nova 100 FM DJ Dylan Lewis, 2Day FM DJs Kyle Sandilands and Jacqueline Ellen Marie Last O’Neil Henderson and imprisoned neo-Nazi Bill White have in common?

All are ‘celebrities’ — of one sort or another.

All have had the indescribable honour of appearing on my blog.

All exist both in and on the margins of reality, and the intersection of popular culture, politics, (new) media and the law. And all have recently been bedevilled by blunders.

Of the cast and crew of The Hal, Liskula, Dylan, Kyle, Jackie, Bill & Co. Show, the two most exceptional are Hal and Bill. Both Hal and Bill are in jail awaiting trial, accused of various crimes, but most significantly of being responsible for issuing threats to kill or injure judges and juries connected to some recent US court cases.

Bill & Hal

A recent summary of one of Bill’s legal battles is detailed in ‘Online threats to juror are protected speech: Judge dismisses indictment on free speech grounds’, David Ziemer, Wisconsin Law Journal, July 28, 2009. In essence: “Case: U.S. v. White, No. 08-CR-851. Issue: Can a defendant be criminally charged for posting a juror’s address on the internet? Holding: No. Where the post does not incite imminent lawless action, it is protected by the First Amendment.”

As for Hal: ‘Internet Radio Talk Show Host Hal Turner Arrested for Threatening Three Federal Appeals Court Judges in Chicago Over Recent Decision Upholding Handgun Bans’, July 28, 2009:

Hal Turner, an intermittent internet radio talk show host and blogger, was arrested today by FBI agents at his home in North Bergen, N.J., on a federal complaint filed in Chicago alleging that he made internet postings threatening to assault and murder three federal appeals court judges in Chicago in retaliation for their recent ruling upholding handgun bans in Chicago and a suburb.

Internet postings on June 2 and 3 proclaimed “outrage” over the June 2 handgun decision by Chief Judge Frank Easterbrook and Judges Richard Posner and William Bauer, of the Chicago-based 7th U.S. Circuit Court of Appeals, further stating, among other things: “Let me be the first to say this plainly: These Judges deserve to be killed.” The postings included photographs, phone numbers, work address and room numbers of these judges, along with a photo of the building in which they work and a map of its location.

Liskula

“I’m tall, I’m blond, I’ve been modeling for many years, and people get jealous,” she said. “If I had to deal with everyone who is jealous, I wouldn’t have time to do anything else.”

Liskula Cohen used to be known as a model; she’s now known as 1) a “skank” and 2) as the person responsible for bringing legal action (January 2009) against the Google corporation, forcing it — by way of a ruling by Supreme Court Justice Joan Madden — to ‘be evil’, and to provide her (and her law-talking guy) with the email address of a blogger responsible for calling her a “skank”. According to Liskula, the email address enabled her to immediately identify the person responsible for the offensive (‘Skanks in NYC’) blog: Rosemary Port, a fellow New York nightclubber with whom Liskula had previously had words.

Currently, it appears that, having established who was responsible for calling her names, Liskula has dropped defamation proceedings. Rosemary, on the other hand, is now threatening to sue Google for failing to protect her privacy (Google faces $15 million lawsuit for releasing blogger information in model row, The Daily Telegraph, August 24, 2009).

Port won’t win — one assumes — but even if she does, it’s a piss in the ocean for Google. More troubling for bloggers who wish to remain (relatively) anonymous — to be precise: those who wish to blog using Google’s Blogger and a traceable email address — is the extent to which the case sets a legal precedent (within US jurisdiction).

Beyond this, I wonder what the implications are for the individuals concerned. For Cohen, the allegation that she is a “skank” (inter alia) will now — presumably — always be associated with her name. This was, obviously, not her intention. In fact, quite the reverse: Cohen was seeking to redress alleged defamation (harmful lies). Having also, apparently, decided not to pursue damages against Port, it could be argued that Cohen is now actually in a worse position, with regards her reputation, than she was before bringing legal action against Google. As Rosemary Port has stated, “By going to the press, she defamed herself. Before her suit, there were probably two hits on my Web site: One from me looking at it, and one from her looking at it. That was before it became a spectacle.”

This kinda thing is also sometimes referred to as The Streisand Effect.

As noted previously, a few weeks ago I was threatened with being sued for defamation by Dylan Lewis’s manager Mark Klemens. This was because of some unkind remarks I’d made about Dylan to the effect that I did not find him to be anywhere near as entertaining as his PR company might otherwise suggest. Curiously, while I didn’t accuse Dylan of being psychotic, or a liar, or a skank, or a ho, his own bio on Nova FM states that he is a prostitute and a gimp.

To anyone but a law-talking guy, this would probably be interpreted as being an attempt at something called ‘humour’. That is, a reasonable person might conclude that such claims — whatever their other qualities — are (were) not to be taken literally.

Or not.

In any case, a post on my blog that, in January 2008, when searching for the term “Dylan Lewis”, appeared on a Google search somewhere on the fourth or fifth (?) page, has been supplanted by another post on the same subject that now appears on the first page.

D’oh!

Kyle & Jackie

Kyle Sandilands and Jacqueline Ellen Marie Last O’Neil Henderson — ‘O’ — are back on the air. This is because Kyle is a “radio rebel”, a “lovable rogue” who “tells it like he sees it” and whose “no holes barred approach and passion for uncovering and championing new talent” makes him “a leader of the ever changing world of multimedia” (and yes, the original quote does read ‘holes’ not ‘holds’). Jackie O, on the other hand, is “one of Australia’s most successful and high profile radio co-host[s], interviewer[s], television presenter[s] and magazine columnist[s]” — still.

Point being: money talks, bullshit walks, and for so long as The Kyle & Jackie O Show brings ratings in key demographics = advertising revenue = profit, they are untouchable. The only standard business has to defend is teh bottom line (Austereo chairman forced to defend on-air standards, The Age, August 24, 2009).

Melbourne : ALP ~versus~ Greens

Another Liberal Party looks set to face quite a battle come next year’s state election (November 2010). Well, in the inner-city anyways. And ah, against The Greens. Which isn’t bad for the ALP as such, but is kinda bad news for the ALP ‘Left’.

The Gang of Four seats under pressure are Brunswick, Melbourne, Northcote and Richmond. Bronwyn Pike (Melbourne) will fight law-talking guy Brian Walters; in Brunswick, Jane Garrett (a law-talking grrl @ Slater & Gordon) will fly the flag for Labor, while waving a Green one will be some-other-person-whose-name-I-don’t-recall. (Of course, if Phil Cleary decides to throw his hat into the ring, Garrett’s fuct.)

In Northcote, Fiona Richardson‘s cuisine currently reigns supreme, while in Richmond Richard ‘Tricky’ Wynne will be crossing swords with Kathleen Maltzahn. ALP campaign director Stephen Newnham has promised to pull out all stops to stop the watermelons from infecting State Parliament, so we can look forward to all kindsa awesome tricksiness on the ALP’s part.

nutzis are W E I R D : Hal Turner

Harold Charles Turner (born March 15, 1962) is a short-arsed (5’2″) white supremacist, street fighter, and former host of ‘The Hal Turner Show’. He is also a self-confessed FBI snitch (informant) and hero to Australian Lord Haw-Haw Carl D. Thompson, who broadcasts on behalf of the US-based ‘National Socialist Movement’. Carl was formerly the editor of (Pauline Hanson’s) ‘One Nation Party’ newspaper, and recent guests on Carl’s show have included Dr James Saleam of Australia First and two members of a local KKK franchise.

On June 24, 2009, Hal was arrested and charged with ‘violating a federal statute which makes it a crime to threaten to assault or injure a judge in retaliation for the performance of their official duties’. Hal has been denied bond (August 10), and is currently sitting in a jail in Chicago awaiting trial.

On the plus side, and not unrelated to his short stature, short fuse, limited intelligence, rank bigotry, delusions of grandeur and love of all things White, Hal is also the loser in a war against the internet, a war he initiated in December 2006 by publishing the phone numbers and addresses of some US teenagers who had pranked him.

The rest is history.

HARTFORD, Conn. — A New Jersey blogger facing charges in two states for allegedly making threats against lawmakers and judges was trained by the FBI on how to be deliberately provocative, his attorney said Tuesday.

Hal Turner worked for the FBI from 2002 to 2007 as an “agent provocateur” and was taught by the agency “what he could say that wouldn’t be crossing the line,” defense attorney Michael Orozco said.

“His job was basically to publish information which would cause other parties to act in a manner which would lead to their arrest,” Orozco said.

Prosecutors have acknowledged that Turner was an informant who spied on radical right-wing organizations, but the defense has said Turner was not working for the FBI when he allegedly made threats against Connecticut legislators and wrote that three federal judges in Illinois deserved to die.

“But if you compare anything that he did say when he was operating, there was no difference. No difference whatsoever,” Orozco said.

Special Agent Ross Rice, a spokesman for the FBI in Chicago, said he would not comment on or even confirm Turner’s relationship with the FBI.

Orozco spoke to reporters after a court hearing in Hartford on Tuesday. Turner, 47, of North Bergen, N.J., did not appear, because he is in federal custody in Illinois. His arraignment on the Connecticut charges was rescheduled to Oct. 19.

In June, Turner urged his readers to “take up arms” against Connecticut lawmakers and suggested government officials should “obey the Constitution or die,” because he was angry over legislation — later withdrawn — that would have given lay members of Roman Catholic churches more control over their parish’s finances.

He wrote in Internet postings the same month that the Illinois federal appeals judges “deserve to be killed” because they issued a ruling that upheld ordinances in Chicago and suburban Oak Park banning handguns. He included their photos and the room numbers of their chambers at the courthouse.

Orozco officially joined Turner’s defense team in the Connecticut case on Tuesday, with approval from Superior Court Judge David Gold. Orozco said his Newark, N.J.-based firm has been representing Turner for the past five years, including during his FBI informant years.

Turner’s Connecticut attorney, Matthew R. Potter, said it’s too early to tell which trial will move forward first. Orozco said he plans First Amendment defenses in both cases.

Randall Samborn, a spokesman for the U.S. attorney’s office in Chicago, said the office would not comment on Orozco’s statements.

‘Do You Want Frankston To Become Like Dandenong?’ is the title of a racist flyer distroed in Frankston in August 2009. The author is unknown. (See : Dulce et decorum est pro patria mori; Or: Go back to Africa and/or Europe, August 20, 2009.)

What is known is that Neo-nazi network Blood & Honour has a presence in Frankston, and is organising a gig in Melbourne on September 12, along with fellow boneheads belonging to the Southern Cross Hammerskins. The ‘Ian Stuart Donaldson’ memorial gig is an annual affair, held each September, last year in Beaconsfield (on the outskirts of Melbourne), in 2007 at the Melbourne Croatia Social Club in Sunshine and in 2006 at The Birmingham Hotel in Fitzroy (now under new management).

Both Blood & Honour and the Hammerskins have been proscribed in a number of foreign jurisdictions on the basis of their promotion of racial hatred and violence, most recently in Spain (see : Hammerskins? ¡Ay, ay, ay, no me gusta!, August 12, 2009) and the Czech Republic (see : Czech Bully Boys face inconvenience, June 16, 2009) but are lawful associations in Australia. Over the last year or so, the two groups — both established c.1993 by Melbourne bonehead Scott McGuinness — have modestly expanded their online activities, introducing a radio show and a new distro, 9percent productions.

Jesse XXXXXX, who maintains the genocidal YouTube channel and uses the 9percent site to flog muzak and neo-Nazi objets de tat, will be prancing about on stage in September with his band, Ravenous; he will presumably be joined by Jason XXXXXX, who maintains the schammerskins site, and local (Victorian) B&H rep Justin XXXXXX. (Note that, while Jesse has withdrawn/been forced to withdraw at least two of his videos — which featured humourous depictions of Jews being killed — those which remain merely celebrate Nazism.) Previous celebrity guests at B&H events have included ‘Australia First Queensland’ representative Jim Perren, the ‘anarchists’ Welf Herfurth and his teenage sidekick Scott XXXXXXXX, and Canberra yuppie Nicole Hanley: all will presumably be attending the Sydney Forum several weeks later.

Finally, note that the 2006 gig was accompanied by an incident in which a group of boneheads monstered a lone (black) woman, while last year Jesse took the opportunity to record the song ‘Oh no here comes an Abo’ with the Belgian neo-Nazi reich ‘n’ roll band Kill Baby Kill; KBK’s vocalist, Dieter Samoy, has a conviction for assault(ing a blackfella).

The flyer claims that the Victorian State Government plans to build “386 high-rise commission flats in the centre of Frankston” and to “fill them with Africans”. In reality, the Government was until recently considering a 7-storey building comprising 80 units at 38 Playne Street. This plan has now been abandoned (Home truths allay ‘ghetto’ fears, Jason Gillick, Frankston Independent, August 11, 2009) and future plans — using Federal Government funds — have yet to be made public.

Francis De Groot Brigade : August 2009 Update

I last updated the Francis De Groot Brigade page in May 2008, so I think it’s about time I did a little tidying.

First, some retirements: Sue Bateman, former One Nation Party candidate and Stormfront member, appears to have left the Party’s WA branch some time before it sank/was de-registered. John Drew, on the other hand, who for some time played the role of both ‘Australia First Party Brisbane’ and the ‘Patriotic Youth League’, has been expelled from his (presumably to concentrate on his tennis-playing and yoga).

Secondly, some shifts: Welf Herfurth has tried to open up a local franchise of the US-based bonehead network Volksfront, while Andrew ‘Fightback’ Sanders has apparently re-emerged elsewhere as ‘Andrew XXXXXXXXX’ of the ‘XXXXXXX XXXXXXXXX XXXXXXXXX’ (a relatively benign grouping). Douglas Schott (Blood Red Eagle) has sailed away from Blood & Honour and the Hammerskins to join Welf aboard his Aryan starship headed for the skies. Carl D. Thompson has left/been expelled from Stormfront and now broadcasts on teh Intertubes for US-based neo-Nazis the ‘National Socialist Movement’.

Thirdly, the parties. In July, Dr James Saleam announced that Australia First had a nominal membership of 525, thus allowing it to apply for registration as a political party with the AEC. Over a month later, the party has still to formally do so. In other news, the party bunker in Tempe was allegedly subject to a failed B&E, which attack Carl D. Thompson (Derrick MacThomas) relates was possibly my doing. Who was responsible for scrawling ’88’ on Eric Roozendaal’s house is also unknown (Neo-Nazi graffiti on Roozendaal home, Brian Robins, Sydney Morning Herald, August 17, 2009).

As for AF’s chief rival on the far right, the Australian Protectionist Party is still aiming at gaining 100 members, thus enabling it to register to contest state elections under its own name. Party leader Darrin Hodges embraced Terrie-Anne Verney by way of Facebook group ‘Fuck off We’re Full’, even raising a few hundred dollar donation for her after she lost her job at a community radio station following her exposure in the media as a racist. Terrie-Anne has returned the favour by agreeing to speak at Saleam and Herfurth’s Sydney Forum in September.

A small number of other racist and fascist groupuscules have emerged in the intervening period: ‘Nationalist Alternative’ being perhaps the most prominent, if not the most significant. A few hundred nationalistic and xenophobic teenagers have also experimented with joining the army in the form of the ‘Southern Cross Soldiers’. The bedsheet-wearers of the KKK have had their pointy-heads in the media on a few occasions of late, although in a bizarre twist the leader of the local franchise of the Indiana-based CNKKKK, variously known as ‘Maxine Grey’ and ‘Tina Greco’, is suspected by AF Queensland member Jim Perren of being… Jewish!

In terms of the local neo-Nazi muzak industry, Blood & Honour and the SCHS (Hammerskins) continue to motor along the autobahn, although not without encountering a few potholes along the way. One was the apparent cancellation of a gig in Perth in April; this was preceded by the exposure of Canberra yuppie Nicole Hanley (currently one of the organisers of the Sydney Forum) as an organiser with the network; a consequence of the B&H forum being hacked.

Stormfront Down Under remains, as ever, quiet under the obedient stewardship of Paul Innes with ‘White Pride World Wide’ (WPWW) Day passing uneventfully, the answer to the question “If a bunch of fags or muslims can organise a march or a rally, then surely we can do the same.” being ‘No’.

Paul Norton — among other things a bourgeois Green opposed to the formation of a revolutionary, internationalist workers party and unable and unwilling to defend the Chinese deformed workers state — has written a scurrilous attack upon The Spartacist League of Australia, a part of the International Communist League (Fourth Internationalist): a revolutionary, internationalist workers party able and willing to defend the Chinese deformed workers state and committed to leading the Australian proletariat, at the head of all the oppressed, in sweeping away the entire capitalist system of wage slavery, repression and war.

His attack is titled ‘Spartz Meanz Fartz – for thirty-five years’ (Larvatus Prodeo, August 19, 2009).

A so-called ‘academic’, Norton writes in his commentary “I take it ICC was the Control COmmission”; thereby demonstrating not only an inability to spell correctly, but also contempt for historical accuracy. The ICC was the ‘International Control Commission’, not the ‘Control COmmission’. It published a report, titled ‘The Logan Dossier: Documentary Evidence and Testimony in the August 1979 Trial and Expulsion of Bill Logan from the international Spartacist tendency for Crimes Against Communist Morality and Elementary Human Decency’.

Model forces Google to reveal ‘skank’ blogger’s identity

A former Vogue Australia cover girl has won a landmark court battle to reveal the identity of an anonymous blogger who called her a “skank” and an “old hag”.

Model Liskula Cohen sued Google in January in the hope of forcing the company to reveal the person responsible for allegedly defamatory comments on a blog called Skanks in NYC, which was hosted by Google’s Blogger service.

“I would have to say the first-place award for ‘Skankiest in NYC’ would have to go to Liskula Gentile Cohen,” the anonymous blogger wrote.

“How old is this skank? 40 something? She’s a psychotic, lying, whoring, still going to clubs at her age, skank.”

Cohen, who is actually 37, believed the posts were defamatory but was forced to take action against Google in order to unmask the blogger’s identity before she could take further action…

Since then, the blogger has apparently not only been identified by Cohen, but forgiven by her too — although defamation proceedings against her (the alleged defamer is female) may still commence (Model confronts ‘skank’ blogger, Asher Moses, August 20, 2009).

The case obviously raises a wide range of questions, but in terms of background, ‘Cohen v. Google (Blogger)’, Sam Bayard, Citizen Media Law Project, January 6, 2009 is excellent — and provides a copy of Justice Madden’s August 17 ruling as a PDF, as well as a range of related links — as is Aaron Morris’s post ‘Anonymous Posters Are Not Immune from Defamation Claims’, Internet Defamation Blog, March 14, 2009.

As noted, the trouble started with a blog titled ‘Skanks in NYC’ — http://skanksnyc.blogspot.com/ — hosted on Blogger (owned by Google). It was established in August 2008, and consisted of five posts, made on the same day, all concerning Cohen. The blog went offline sometime in March, and I can find no trace of it anywhere.

I myself have been threatened with legal action inre allegedly ‘defamatory’ comment twice: first, in April 2008, by the proprietors of mathaba.net; secondly, on August 6, 2009. On that occasion, I received an email from Mark Klemens, Managing Director of the Australian-based company Profile Talent Management (“a strategic, proactive and well connected talent management company that successfully creates and maximizes opportunities for its clients with major media partners”). Mark wrote:

Dear Sir, We represent Dylan Lewis. It has come to our notice that a website titled “slackbastards” which appears to be controlled or owned by you has made reference to Dylan. Under the subheading “Number One’s” references to Dylan of a defamatory nature have been made. We have obtained legal advice confirming the status of the material as being offensive and defamatory. We seek to have the article/paragraph removed immediately from the website.

Should you not remove the offending material we are instructed to brief solicitors on behalf of our client to seek an injunction and damages.

Neither case generated any interest outside of a very small (tiny) circle of fellow bloggers.
